This document constitutes a legally binding medical benefits contract between the undersigned individual and TelaCare Health Solutions, LLC. You must read this document thoroughly.
**Services Provided: **
TelaCare Health Solutions, LLC offers internet-based healthcare resources designed to connect individuals with U.S. board-certified physicians, licensed therapists, and other licensed healthcare practitioners (referred to as "Providers") in real-time through live video, telephone communication, and secure email. These interactions facilitate the diagnosis and treatment of patients via the Internet, as well as the provision of various administrative services and informational resources (collectively referred to as "Services"). All participating providers operate independently under contracts with TelaCare Health Solutions, LLC, henceforth referred to as "TelaCare" or "TelaCare Health," and the designated website is https://www.telacare.com. Engagement with the Providers through the Services is intended to complement, rather than replace, your existing relationship with your primary care physician. It is important to note that TelaCare does not function as an insurance product, nor does it serve as a prescription fulfillment service. Providers affiliated with TelaCare retain the discretion to deny care in cases of actual or potential misuse of these Services.
**Account Enrollment, Eligibility, and Services: **
To utilize the Site and Services, you must represent and guarantee that you are at least eighteen (18) years of age and possess the legal authority to agree to the TelaCare Terms of Use on your behalf or on behalf of a minor child for whom you are a parent or legal guardian. You agree to register for TelaCare Services under your name and to utilize the Services in compliance with all relevant state and federal laws. You further agree to create your TelaCare Account in a complete, accurate, and truthful manner, providing information that includes, but is not limited to, your name, mailing address, phone number, email address, and medical history. This information will form part of your TelaCare Medical Profile. To ensure compliance with these Terms of Use, TelaCare reserves the right, although it is not obliged, to monitor your access to and use of the Site and the Services. At its sole discretion, TelaCare may refuse to provide care in instances of actual or potential misuse of the Services or non-compliance with these Terms of Use.
**Medical Emergencies: **
It is critical to emphasize that TelaCare's Site and Services are NOT INTENDED for use in medical emergencies. You agree to refrain from disregarding or delaying medical care based on information presented on the TelaCare Site or recommendations provided by TelaCare. IF YOU SUSPECT MEDICAL EMERGENCY, YOU MUST CALL 911 IMMEDIATELY.
**Billing Policy: **
TelaCare functions as a virtual medical benefits company offering monthly, quarterly, and/or annual medical care contracts. TelaCare is not an insurance company, nor does it fulfill government insurance coverage requirements. The company does not provide single-use care options. You acknowledge that a single-use arrangement implies you cannot enroll, utilize the Services once, and subsequently cancel. The contract terms stipulate a minimum engagement period of one (1), three (3), or twelve (12) months. Even in the case of non-utilization of the Service, you remain financially obligated until the conclusion of your contracted term. It is essential to understand that, akin to any medical benefits, non-utilization does not qualify for a refund concerning any unused duration of the services. Patients who make false claims of fraud or initiate chargebacks will bear responsibility for any additional costs incurred should collection efforts be required to recover losses. The recurring fee of $49.95 per month (minimum one-month commitment) $99.95 per month (minimum three-month commitment), or $299.95 annually (minimum twelve-month commitment) will be charged to the credit or debit card provided during registration. You comprehend that each plan necessitates a minimum commitment of one (1), three (3), and/or 12 (twelve) months prior to any contract cancellation. Should you opt not to cancel after the minimum term, your contract will auto-renew at the same contract level until formally canceled, in accordance with the terms specified for cancellation. Following the fulfillment of the contract term, you may terminate your contract by accessing Account Settings and selecting CANCEL ACCOUNT, or by emailing billing@telacare.com with your account details.
**Collection Policy: **
Accounts that are delinquent and/or in breach of contract terms will be considered in default and subsequently referred to a third-party collection agency. While TelaCare is not obligated to provide prior notification before forwarding an account to a debt collector, efforts will be made to collect the outstanding debt directly from the account holder prior to such action. Should these efforts prove unsuccessful, written notification will be sent via electronic means, and the debt will be processed with our third-party collection agency. Once an account has been referred to collections, it cannot be halted or settled directly with the account holder. All actions will adhere to applicable laws and fair credit practices as prescribed by the Consumer Financial Protection Bureau (CFPB) https://www.consumerfinance.gov/.
**Refund Policy: **
All sales are considered final; no refunds will be issued for benefits purchased from TelaCare. By signing below, the individual acknowledges and accepts this refund policy as part of the contract. Services may be canceled at the user's discretion under Account Settings upon the completion of the contract term, in accordance with our billing and policy guidelines. Any chargebacks initiated in bad faith will be referred to a third-party collection agency and reported to all three major credit reporting agencies: Equifax, Experian, and TransUnion, as detailed in the collection policy outlined in this contract.
**Prescription Policy: **
TelaCare operates in compliance with state and federal regulations, with the issuance of prescriptions left to the sole discretion of the medical Provider. TelaCare does not function as a prescription fulfillment warehouse. Should a Provider choose not to prescribe medication, this decision does not constitute grounds for termination of services or a refund. Prescriptions will only be provided based on the Physicians' professional judgment of appropriateness. TelaCare does not guarantee the issuance of any prescription. Furthermore, TelaCare Providers do not prescribe DEA-controlled substances, scheduled medications, non-therapeutic drugs, or any other substances deemed potentially harmful due to their risk of abuse. You agree that any prescriptions acquired from a TelaCare Provider are strictly for personal use. You also commit to thoroughly reviewing all prescription information and labels provided, and to contacting a physician or pharmacist should any questions arise. By electronically signing this document, you affirm that you have read, understood, and accepted the TelaCare Health Solutions, LLC Privacy Policy, Terms of Use, Disclaimer, and Informed Consent materials provided on this Site as an integral part of this contract. I hereby confirm that I have read, comprehended, and agree to the medical benefits contract of TelaCare Health Solutions, LLC.
