This is a legally binding medical benefits contract between you and TelaCare Health Solutions, LLC; please read it carefully.
TelaCare Health Solutions, LLC provides internet healthcare resources to connect individuals with U.S. board-certified physicians, licensed therapists, and other licensed healthcare practitioners (the "Providers") in real-time via live video, telephone, and/or secure email for the diagnosis and treatment of patients over the Internet, as well as providing other types of administrative services and information ("Services"). All participating Providers have independently contracted to be in the network operated by TelaCare Health Solutions, LLC, hereinafter referred to as ("TelaCare") ("TelaCare Health"), and Site https://www.telacare.com.
Your interaction with the providers through the Service is intended to supplement your relationship with your existing primary care physician. TelaCare is not an insurance product nor a prescription fulfillment warehouse. TelaCare physicians, therapists, and health care practitioners reserve the right to deny care for actual or potential misuse of these Services.
Account Enrollment, Eligibility, and Services:
TelaCare's Site and Services are NOT FOR use for medical emergencies. You agree NOT to disregard or delay seeking medical care based on anything that appears on the Telacare Site, or you are told by TelaCare. IF YOU BELIEVE YOU HAVE A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY!
TelaCare is a virtual medical benefits company providing monthly and/or annual medical care. We are not insurance and DO NOT meet governmental insurance coverage requirements. We DO NOT offer single (1) one-time-use care options. You understand that single (1) one-time-use care means you cannot sign up, use Services once, and cancel. Our contract terms are for monthly recurring with a minimum of three (3) months or one (1) year annual recurring only. Even if you do not use the Service, you are still obligated to pay until your contract term has ended. As with any medical benefits, just because you don't use them DOES NOT mean you can be refunded for any unused portion. Patients who falsy claim fraud or chargebacks will be liable for additional costs incurred should collections be required to recoup losses.
The recurring fee of $39.95 monthly (min 3 months) or $299.95 annually (min 1 year) will be charged/debited by TelaCare, to the credit/debit card you use today. You understand the monthly plan requires you to agree to a minimum of three (3) months before canceling your contract. Should you choose NOT to cancel after the minimum three (3) month term, your contract will continue on a month-to-month basis until you cancel, according to the contract terms listed for canceling. Your contract benefits may be canceled after the contract term is satisfied by clicking on Account Settings and choosing CANCEL ACCOUNT. You may also cancel your contract by emailing email@example.com with your account information.
Delinquent accounts and/or accounts in breach of contract terms deemed in default will be referred to a third-party collection agency. While TelaCare is not required to notify you before sending your account to a debt collector, we will try to collect the debt from you before sending it to a third-party collector. If we are unsuccessful, we will notify you in writing via an electronic form and process the debt to our third-party collection firm. After an account has been sent to collections, we cannot stop it or settle the debt with you. All applicable laws and fair credit practices will be followed as per the Consumer Financial Protection Bureau (CFPB) https://www.consumerfinance.gov/.
All sales are final; no refunds on benefits purchased from TelaCare will be offered. By signing below, you accept this refund policy as part of the contract. Services can be canceled in the system at your discretion under Account Settings upon completion of your contract term as per our billing and policy terms. All chargebacks you initiate in bad faith will be sent to a third-party collection company and reported to all three (3) credit reporting agencies, Equifax, Experian, and TransUnion, as outlined in this contract under the collection policy.
TelaCare operates subject to state and federal regulations, and prescriptions are at the sole discretion of the medical Provider. TelaCare is not a prescription fulfillment warehouse. If a Provider does NOT prescribe a medication, that is not a reason for termination or refund. Physicians will only prescribe medication as appropriate in their professional judgment. TelaCare does not guarantee that a prescription will be written.
TelaCare Providers DO NOT prescribe DEA-controlled substances or scheduled medications, non-therapeutic drugs, and certain other drugs which may be harmful because of their potential for abuse. You agree that any prescriptions you acquire from a TelaCare Provider shall be solely for your personal use. You agree to fully and carefully read all provided prescription information and labels and contact a physician or pharmacist if you have any questions.
